What is the status of the leader of a political party or a combination of parties , who has staked his claim to form the government with the President of India? Once, the President is convinced about the claim, he appoints such a leader as the Prime Minister , though swearing- in-ceremony can take place at a later stage.
So, the status of Narendra Modi, today is that he has been appointed by President Ram Nath Kovind as the Prime Minister under Article 75(1) of the Constitution.
” Exercising powers vested in him under Article 75 (1) of the Constitution of India, the President, Shri Ram Nath Kovind, … appointed Shri Narendra Modi to the office of Prime Minister of India”, said a press communique from the Rashtrapati Bhawan. According to the communique , the President has requested Modi to: ” advise him about the names of others to be appointed members of the Union Council of Ministers; and indicate the date and time of the swearing-in-ceremony to be held at Rashtrapati Bhavan ”.
Modi has been elected as leader of the BJP Parliamentary Party which has a strength of 303 MPs in the Lok Sabha (Lower House). With total strength of the National Democratic Parties like Shiv Sena, Shiromani Akali Dal, Lok Jan Shakti and Janata Dal (United), among other smaller constituents, Modi will have support of 353 MPs in a House of 542 (with one vacancy).
